General Terms and Conditions

§1 Applicability to Businesses and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity (§ 13 BGB).

§2 Conclusion of Contract, Storage of the Contract Text
(1) The following provisions regarding the conclusion of the contract apply to orders placed via our online shop https://www.goosecreekcandle.de.

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer makes a binding contractual offer by successfully completing the ordering process provided in our online shop.
(5) The product images in our online shop are largely manufacturer images. The manufacturer reserves the right to change the name, color, and design at any time. Deviations in color or label design do not constitute grounds for complaint.

The ordering process consists of the following steps:
1) Select the desired product
2) Confirm by clicking the "Add to Cart" button
3) Review the information in the shopping cart
4) Click the "Checkout" button
5) After registering and entering your login details (email address and password), log in to the online shop.
6) Review or correct the entered data again.
7) Submit the order by clicking the "Order with payment" or "Buy" button.

Before submitting the order, the consumer can return to the website where the customer's details are recorded by clicking the "Back" button in their internet browser after checking their details. They can correct any input errors or cancel the ordering process by closing the internet browser. We will immediately confirm receipt of the order (submission of a purchase offer) via an automatically generated email ("order confirmation"). This does not constitute acceptance of your purchase offer, but merely confirms receipt of your purchase offer. Our acceptance of the purchase offer occurs with the dispatch of the goods invoice on the day of dispatch.

(6) Storage of the contract text for orders placed through our online shop: We store the contract text and send you the order details and our General Terms and Conditions by email. You can also view the General Terms and Conditions at any time at http://goosecreekcandle.de/GTCs.

You can view your past orders in our customer area under "My Account" --> "My Orders."

§3 Prices, Shipping Costs, Payment, Due Date
(1) The stated prices include statutory sales tax and other price components. Any shipping costs are added.

(2) The consumer has the option of paying in advance, via PayPal, or Amazon Pay.

(3) If the consumer chooses to pay in advance, they agree to pay the purchase price immediately after conclusion of the contract.

§4 Delivery
(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will take place within two working days at the latest. For advance payment, the delivery period begins on the day after the payment order is sent to the credit institution responsible for the transfer; for all other payment methods, the delivery period begins on the day after the contract is concluded. If the delivery period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item, even in the case of online purchases, only passes to the buyer upon delivery of the item to the buyer.

§5 Retention of Title
We retain title to the goods until the purchase price has been paid in full.

of your decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the date on which we received notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; Under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You will bear the direct cost of returning the goods.

§7.2 Products excluded from cancellation/returns:
Hygienic products such as body sprays, body lotions, shower gels, hand creams, foam soaps, and room sprays are subject to Section 312g Paragraph 2 No. 3 of the German Civil Code (BGB).

§7.3 Condition of the goods upon delivery
Please check the condition of the goods immediately upon receipt and report any damage to our support team by email. Crooked/bent labels, bubbles, scratches, creases, or damage to candle labels, as well as candle lids, are generally excluded from the warranty. We are not the manufacturer of the product. According to the manufacturer, the properties described above do not affect the fragrance release or burning behavior.

§7.4 Undeliverable Shipments
All shipments that are not returned to us as a declared return will initially be stored until you contact us. We will then investigate why a package was returned to us (e.g., storage period exceeded, recipient unavailable, etc.).
We can then treat these shipments as returns or, upon request, resend them to you. In both cases, you will incur additional costs, as we are not liable for undeliverable packages.
If we record your shipment as a return, we will refund the purchase price less the return shipping costs charged by DHL. If you request redelivery, we will invoice you for the return shipping and reshipment costs, which you must transfer to us. Once we receive this transfer, we will arrange for your shipment to be resold.

§8 Warranty
The statutory warranty provisions apply.

§8.1 Product characteristics: During the production of candles with soy wax, unevenness in the candle surface, as well as small holes or bumps due to the soft wax, may occur. These are due to production and do not constitute a product defect. The fragrance release and burning behavior are not affected. Wax discoloration and wax residue on the jars are also possible. These are also due to production and cannot be recognized as defects.
